PUSH THAT BUTTON COMPETITION TERMS AND CONDITIONS
1.SUMMARY
- 1.1This “Agreement” is made up of the Competition Information set out on the competition page on Push That Button and these Competition Terms. Please ensure you read both carefully. In the event of a conflict between these Competition Terms and the Competition Information, then the Competition Information will prevail.

This Agreement is a binding legal agreement between PTB and you. By entering the competition, you agree to be bound by this Agreement.
- 1.3
This Agreement may change from time to time without notice. Every time you use the App you are deemed to have accepted the latest version of this Agreement in place at that time. Please check our website or the App for any updates to the Agreement each time you use the App.

2.PUSH THAT BUTTON
- 2.1Push That Button is an app (the "App") and accompanying service that allows brands and talent (“Talent”) to run prize draw competitions which members of the public can search for, and enter, for a chance to win exciting prizes.
- 2.2PTB Group Ltd "PTB", a company incorporated in England and Wales with registered address at Office One 1 Coldbath Square, Farringdon, London, England, EC1R 5HL, and company number 13710528, operates the App and competition.
3.HOW TO ENTER
- 3.1
A full description of the competition is set out in the Competition Information, including all relevant dates, such as the dates within which you can enter, and the date the winning entries will be selected and announced ("Announcement Date").
- 3.2
In order to submit an entry to the competition (a "Submission"), you must:
- 3.2.1
set up a user account with Push That Button;
- 3.2.2
navigate to the competition page within the App;
- 3.2.3
press the red button; and
- 3.2.4
answer the question displayed on screen within ten (10) seconds.
If you answer the question correctly, your Submission will be entered into the competition (an "Entry").

You are automatically entitled to make three Submissions, and you will automatically make an Entry for every correctly answered question. The more Entries you submit, the higher your chances of winning.
- 3.4
Details of the means through which you can make more than three Submissions to the competition are provided in the Competition Information. For the avoidance of doubt, if you decide to obtain ‘bonus entries’ by signing up to Talent or other third party’s mailing lists, you are solely responsible for ensuring that you agree with such Talent or third party’s privacy terms before sharing your personal data with them.

There will also be the option to purchase options to make a Submission for premium competitions. The price for doing so will be clearly set out at the time you purchase such options (inclusive of VAT). In order to make a Submission using the options to enter premium competitions the process to make such Submission and make an Entry shall be the same process as set out in Clause 3.2 above. Payment to purchase options to make a Submission to such premium competitions does not guarantee an Entry or any prizes.

A competition may also be run in partnership with a charity, where the Competition Information will also clearly set out how such competition will be run and what element of the paid Submission will be donated to the charity from the proceeds. Payment to make a Submission for such competitions does not guarantee you an Entry or any prizes.
- 3.7
PTB will not accept:
- 3.5.1
any responsibility for competition entries that are lost, mislaid, damaged or delayed in transit, regardless of cause, including, for example, as a result of equipment failure, technical malfunction, systems, satellite, network, server, computer hardware or software failure of any kind; or
- 3.5.2
proof of transmission as proof of receipt of entry to the competition.

By making a Submission, you:
- 3.6.1
agree to be bound by this Agreement;
- 3.6.2
confirm that you are eligible to enter into the competition and claim the prize(s) (as described in Section 6 of these Competition Terms). PTB may require you to provide proof that you are eligible to enter the competition; and
- 3.6.3
acknowledge that PTB reserves all rights to disqualify you if your conduct is contrary to the spirit or intention of the competition.

PTB can refuse or exclude any Submissions for any reason, without notice to you.
- 3.10
You cannot enter the competition if you or any person related to you is an employee, consultant or agent of PTB, Talent or any of their affiliates.
- 3.1
4.ELIGIBILITY
- 4.1
In order to enter the competition, you must:
- 4.1.1
meet the eligibility criteria set out in the Competition Information;
- 4.1.2
have access to the internet and the App; and
- 4.1.3
be a resident, and have a postal address, in the United Kingdom, and it must be lawful for you to enter the competition in the United Kingdom.

To confirm, no purchase is necessary in order to enter the competition (although data rates may apply) and any purchases you make will not affect your chance of winning.
- 4.3
PTB reserves all rights to disqualify you if your conduct is contrary to the spirit or intention of the prize competition or any laws, rules, regulation or guidance issued by relevant platforms.

Competition entries cannot be returned.
- 4.1
5.PRIZES
- 5.1
The winning Entry/ies to the competition will be picked at random by an algorithm of the App. The choice of winning Entry/ies by the algorithm will be final.
- 5.2
Details of the:
- 5.2.1
prizes to be won via the competition; and
- 5.2.2the dates within which prizes must be redeemed (the "Redemption Period")
are provided in the Competition Information.

- 5.3
If you are a winner but you fail to redeem the prize within the Redemption Period, the prize will be forfeited
- 5.4
Prizes are not negotiable, transferable, cannot be combined with any other offer and no cash alternative is offered, and PTB reserves the right to replace the Prizes with alternative prizes of equal or higher value without notice to you.
- 5.5Prizes may be subject to separate terms and conditions which we recommend that you review. A link to these will be available in the Competition Information.
- 5.6Unless stated otherwise in the Competition Information, prizes do not include any incidental expenses incurred in relation to the prize.
- 5.7Talent is solely responsible for ensuring the winner receives the prizes offered in the competition. PTB are not responsible for any prizes.
- 5.1
6.WINNER
- 6.1
The decision of the algorithm with regards to the winner of the competition is final and no correspondence or discussion will be entered into.
- 6.2
The announcement of the winner(s) on the announcement date may be made publicly and refer to the winner(s) by name.
- 6.3Details of how the winner(s) will be contacted by PTB in order to arrange delivery or fulfilment of the prize (the“Prize Notification”) will be provided in the Competition Information.
- 6.4Details of how the winner(s) can claim the prize(s) will be provided in the Competition Information ("Claim Requirements"). If the Claim Requirements are not complied with, the prize(s) will be forfeited and awarded to different entrants, who will be chosen at random using the Push That Button algorithm.
- 6.5
A prize may not be claimed by a third party on behalf of a winner.
- 6.6
In order to comply with its obligations under the UK Code of Non-broadcast Advertising, Sales Promotion and Direct Marketing, PTB must send the surname and county of the winner(s) to any other entrant who requests this information from PTB using the contact details set out in the Competition Information within one (1) month after the closing date of the competition.
- 6.7
If you object to any or all of your surname and county being published or made available, please contact PTB using the contact details set out in the Competition Information. In such circumstances, PTB must still provide the information and winning Entry to the Advertising Standards Authority on request.
- 6.8
PTB may cancel, vary or withdraw the prize(s) if the competition or the prizes are, or become, unlawful in your country of residence.
- 6.9
PTB may request any winner to take part in publicity.
- 6.1
7.GENERAL
- 7.1
Insofar as is permitted by law, PTB will not in any circumstances be responsible or liable to compensate the winner(s) and/or any other entrants, or accept any liability for any loss, damage, personal injury or death caused by:
- 7.1.1
participation in the competition;
- 7.1.2
the winner claiming or using the prize(s); and
- 7.1.3
third parties (including losses, damages or delays caused by third party fraud or any failure of any communication network),
except where it is caused by the negligence of PTB or that of their employees. To confirm, entrants’ statutory rights are not affected.
- 7.1.1
- 7.2
For the avoidance of doubt, to the fullest extent permissible under the relevant law, PTB shall not be liable to you, in contract, tort (including, without limitation, negligence) or otherwise in connection with a prize for: (a) loss of revenues, profits, contracts, business or anticipated savings or loss of data; or (b) any loss of goodwill or reputation; or (c) any special or indirect or consequential losses, however caused.
- 7.3PTB will comply with all applicable data protection laws, and where relevant, PTB will only process your personal data as set out in its Privacy Policies, which you have agreed to and a link will be provided in the Competition Information.
- 7.4
If PTB has any reason to believe that there has been a breach of this Agreement by you, PTB may, at its sole discretion, reserve the right to exclude you from participating in the competition.
- 7.5
PTB reserves the right to hold void, suspend, cancel, or amend the competition where it becomes necessary to do so, as determined by PTB in its sole discretion. PTB may also change this Agreement at any time, and those changes will take effect immediately and be posted here
- 7.6
This Agreement shall be governed by English law, and the parties submit to the non-exclusive jurisdiction of the courts of England and Wales.
- 7.7
If any provision of the Agreement (or part of any provision) is found by any court or other authority of competent jurisdiction to be invalid, illegal or unenforceable, that provision or part-provision shall, to the extent required, be deemed deleted and not to form part of the Agreement, and the validity and enforceability of the other provisions of the Agreement shall not be affected.

PTB makes no representation that this competition is lawful or appropriate outside of the United Kingdom. If you access the competition from outside of the United Kingdom, you are responsible for compliance with all applicable local laws, and you should consider and comply with any local and applicable laws that may restrict your entry to this competition.
- 7.9
A prize is in no way sponsored, endorsed or administered by, or associated with Facebook, Twitter or Instagram and if you enter a Prize Promotion, you release Facebook, Twitter and Instagram from any and all liabilities in connection therewith (if and as applicable).
- 7.1
